Spouse Open Work Permit

A Spouse Open Work Permit (OWP) allows the spouse or common-law partner of a Canadian citizen or permanent resident to work in Canada without needing a job offer or a Labour Market Impact Assessment (LMIA). This work permit is not tied to a specific employer or job and is usually issued for the same duration as the spouse’s study or work permit.

To be eligible for a Spouse OWP, the foreign national must meet the following requirements:

  1. They must be legally married to a Canadian citizen or permanent resident, or in a common-law relationship with a Canadian citizen or permanent resident for at least one year.

  2. They must have valid temporary resident status in Canada as a visitor, student, or worker.

  3. They must apply for the work permit from within Canada.

  4. They must include a copy of their spouse’s Canadian citizenship or permanent residency document, along with other required documents.

  5. They must not be inadmissible to Canada for reasons such as criminality, security, or health.

It’s important to note that a Spouse OWP does not automatically grant the holder permanent residency status in Canada. However, it can be a valuable opportunity for the spouse or common-law partner to gain work experience in Canada, which may be a valuable asset in their future immigration applications.
