Who is considered a minor?

A person under the age of majority is considered a minor child. The age of majority is 18 years in Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, Saskatchewan, and 19 years in British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Yukon.

When a minor needs a study permit?

Generally, a minor child needs study permit only if he is accompanied by parent who is a visitor of Canada and not authorized to work or study.

Minors don’t need study permit in the following situations:

  • If the minor is foreign national accompanied by a parent who is Canadian citizen or permanent resident
  • If the minor is travelling alone to Canada, but it is recommended to apply for study permit in this case.
  • If the minor is with a parent who is authorized to work or study in Canada
  • If the minor is refugee or refugee claimant whose parents are refugee or refugee claimant
  • If the minor is in Canada without status

If the minor reach the age of majority while he is studying in Canada without permit, he must apply for study permit to continue studying.
